2Emergency & Crisis Disclaimer

2.1

Not an Emergency Service

The Platform is an online matching, administrative, and booking portal for scheduled psychological therapy. It is not an emergency, crisis, or immediate triage service.

2.2

Immediate Risk

If you are in danger, experiencing a severe mental health crisis, or considering self-harm, you must not rely on this Platform. You must immediately call 999 or 112 (in the UK), attend your local Hospital Accident & Emergency (A&E) department, or contact Samaritans on 116 123.

3Nature of Services & Clinical Roles

3.1

Platform Role as Agent

The Platform provides administrative infrastructure, directory listing, appointment booking systems, and payment facilitation as an agent. Contracting for therapy sessions takes place directly between you and your designated Associate Therapist.

3.2

Independent Associate Practitioners

Clinical therapy, consultations, and assessments are provided directly by self-employed practitioners ("Associate Therapists").

3.3

Professional Membership & Insurance

Associate Therapists confirm independent licensing, accreditation, or registration with recognised UK bodies (e.g., BABCP, BACP, UKCP, HCPC, NCPS, NMC, SWE, BPC) and maintain independent professional indemnity insurance.

3.4

Child & Youth Services (Aged 6+)

Services delivered to individuals under 18 years of age (available for children aged 6 years and older) require contract execution and explicit consent by a parent or legal guardian acting on their behalf.

3.5

Medical & Clinical Responsibility

Associate Therapists exercise independent clinical judgment. Session advice or information cannot substitute for an examination by a medical doctor. Users must ensure they are fit to undertake therapy and provide necessary GP/emergency contact details when requested for safeguarding purposes.

4Bookings, Cancellations, Promotional Bundles & Refunds

4.1

Booking Portal & Communications

All session requests, bookings, and financial transactions must be conducted through our integrated booking system (powered by SimplyBook.me). Sessions become binding upon booking confirmation.

4.2

Standard Notice Period (48 Hours)

Individual single sessions may be rescheduled or cancelled provided at least 48 hours’ (or 2 working days') advance written notice is given via the booking portal or by contacting your Associate Therapist or [email protected]. Cancellations made with less than 48 hours' notice forfeit the full session fee.

4.3

Non-Refundability Standard

Save for statutory consumer rights set out below, single sessions, pre-paid session blocks, promotional bundles, and specialist assessment packages are strictly non-refundable once purchased.

4.4

Statutory 14-Day Cooling-Off Right

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your booking within 14 days of purchase without giving any reason.

4.5

Immediate Performance & Pro-Rata Deductions

Where you schedule or take a session within the 14-day statutory cooling-off period, you explicitly request that service delivery begin immediately. If you cancel a package within the 14-day cooling-off window after one or more sessions have occurred:

  • You will receive a pro-rata refund for remaining unperformed sessions.
  • Deductions for delivered sessions will be calculated based on standard single-session rates.
4.6

Generic Promotional Packages, Bundles & Refund Deductions

  • Promotional Discounts & Bonus Sessions: Where sessions are purchased as part of a promotional package, multi-session block, or offer containing bonus sessions, free bonus sessions hold £0.00 cash redemption value and cannot be refunded or converted into credit.
  • Discovery Call Credits: Where a promotional bundle or package price reflects a discount or refund applied from a prior Discovery Call (e.g., crediting a £45 Discovery Call fee), that £45 Discovery Call credit/discount shall be deducted from any statutory refund calculation.
  • Administrative Deductions: Any eligible statutory refund for a cancelled promotional bundle or multi-session block shall be calculated as follows:
    Net Refund= Price Paid− Standard Value of Delivered Sessions− £45 Discovery Call Deduction− £100 Administrative Fee
4.7

Specialist 4-Session Children’s Occupational Health Assessments

Delivered over a 4-session framework for children aged 6+. Due to clinical preparation, psychometric analysis, and report drafting, once the 14-day statutory cooling-off window has elapsed (or once 2 or more assessment sessions have been delivered), the assessment package is non-refundable as a single integrated health service.

4.8

Associate Cancellation or Late Attendance

If an Associate Therapist cancels a session within 48 hours, is more than 20 minutes late without reasonable adjustments, or fails to attend, you may request a replacement session or a refund by emailing [email protected]. Refunds are processed via the booking system or BACS.

5Limitation of Liability

5.1

Statutory Exclusions

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable UK law (including the Consumer Rights Act 2015).

5.2

Platform Disclaimer

The Platform is strictly limited to connecting you with Associate Therapists and providing administrative/booking infrastructure. The Platform is not liable for the clinical acts, omissions, or session content provided by independent Associate Therapists.

6General Provisions & Third-Party Suppliers

6.1

Severability & Variation

If any provision is deemed unenforceable, it shall be modified to the minimum extent necessary or severed without affecting the remaining terms. Terms may be updated periodically.

6.2

Governing Law

Governed by and construed in accordance with English law, with exclusive jurisdiction in the courts of England and Wales.

6.3

SimplyBook.me Integration

SimplyBook.me acts as a technology supplier for The Online Therapy Clinic UK LTD, processing personal data in line with their Privacy Policy and our Data Processing Agreement (DPA): https://simplybook.me/en/terms-and-conditions#tab-for-clients.
